    767 Assault

    There are many different kinds of assault under the Canadian Criminal Code, including assault with a weapon, assault causing bodily harm, aggravated assault, and several types of sexual assault.


  • What is considered assault?
    Generally, assault is where one person does something which is forceful or which threatens force to another person without their consent or permission. There is no requirement for actual physical harm or injury. For example, if you have been seriously threatened with force, or if force has been used against you, the person who committed these acts can still be charged with assault.


  • What is considered sexual assault?
    Sexual assault means any sexual activity which is done without the consent or permission of one of the people involved. In some cases, such as where the consent is obtained through dishonest means, or with an underage victim, consent will not matter. Specific sexual assault charges include sexual assault, sexual assault with a weapon, sexual assault causing bodily harm, and aggravated sexual assault.

    Both assault and sexual assault apply to violence between spouses and partners. If you believe that you have been assaulted, you should call the police right away.
