    299 How long does Patent protection last?

    If your patent application is accepted and you obtain a patent in Canada, you have the right to exclude others from making, using, or selling your invention for a maximum of 20 years from the day you filed your application in Canada.


  • Maintenance fees
    To maintain your patent application and patent over this period, you must pay an annual maintenance fee. This fee increases as the 20 year period passes. If you do not pay the fee, your patent or patent application will lapse, which means that other people will be allowed to use the invention without your permission.
