Ontario|Intellectual PropertyCopyright 319 How to register a Copyright Registering a copyright involves several steps. You must fill out a standard application form and pay an application fee of $65. You may also have to submit a copy of your work to the National Library of Canada.
- Application form
A copyright application kit is available from the Copyright Office. On the application form you must include the full legal name and the complete address of the owner or owners of the copyright. The owner is usually the creator or author of the work, but if you want to register an assignment or license of a copyright, the owner will be the buyer or licensor.
- Copyright categories
Next, the application form asks you to choose a copyright category for your work. The instruction sheet provides examples of the available categories. You must also provide a title for your work. On the application form you must also indicate whether the work has ever been published, and the owner or someone authorized to act on behalf of the owner must sign the form.
- Library Deposit
The final step in registering a copyright is to determine if you need to send copies of your work to the National Library of Canada. Under the National Library Act, copies of any new "library matter" must be sent to the National Library within one week of publication.
- Copyright Office
After the Copyright Office receives your application and registration fee, they will review it to make sure it is completed properly. If any changes need to be made, they will inform you. Once the application has been accepted, the Copyright Office will send you a registration certificate.
The entire registration process may take approximately four to eight weeks. If the Copyright Office has any questions or concerns about your application it may take longer. If your application is accepted you will receive a certificate of registration.
