Ontario|Landlord & TenantResidential 438 Landlords: Offences under the Act The Tenant Protection Act establishes the rights and obligations of landlords and tenants. If landlords violate tenants' rights or fail to live up to their obligations, they may be investigated and charged with an offence. These offences include: harassment, evicting a tenant without an order from the Ontario Rental Housing Tribunal, interfering with the supply of water, electricity or heat, entering a unit without proper notice, charging extra fees or illegal rent, and failing to maintain building standards.
If tenants believe an offence has been committed by the landlord or the landlord's employee, they can make a complaint to the Investigations Unit of the Ministry of Municipal Affairs and Housing, which is listed in the Blue pages of the telephone book. If a complaint is filed, the Investigations Unit will investigate the problem, attempt to resolve it, and may even lay charges against the offender who will have to stand trial in court.
For additional information on offences and penalties, you can call the Ontario Rental Housing Tribunal's information line or contact a legal clinic in your area. These numbers are listed in the Blue pages of the telephone book.
