Ontario|Small Claims CourtGarnishment 568 Garnishment hearing: Correcting problems Sometimes there are mistakes or problems with a garnishment situation. For example, the garnishee may not be paying the creditor, the creditor may be garnishing from the wrong person, or the debtor may claim that the creditor has already been paid in full.
If there is a problem with the garnishment, the debtor, the creditor or the garnishee can each ask the court to schedule a Garnishment Hearing which is usually held in front of a judge. The judge will hear each person's story, and decide how to solve the problem.
To request a Garnishment Hearing you may write a letter to the court requesting one. Be sure to include the court file number in your letter.
