Can you bring cannabis products into the U.S.?
Region: Ontario Answer # 2580No. You cannot bring cannabis or any product containing cannabis (including CBD oil), whether it is for recreational or medicinal use, into the U.S. It is illegal to do so and can result in serious penalties under both Canadian laws, including the Cannabis Act, the Canadian Criminal Code, and U.S. federal laws, such as the Immigration and Nationality Act (INA) and the Controlled Substances Act (CSA).
Even if you are going to a U.S. State where cannabis possession is legal, you are not permitted to bring cannabis to the U.S. The sale, possession, production, distribution, importing and exporting of cannabis across U.S. borders in any form or amount remains illegal under U.S. federal laws.
Only Health Canada can issue permits or grant exemptions to export cannabis, and only in limited circumstances, including for scientific purposes or for industrial hemp. For more information, refer to topic 2445 Is it legal to import or export cannabis?
Can you bring cannabis paraphernalia into the U.S.?
Along with cannabis and products containing cannabis, drug paraphernalia are also considered illegal contraband in the U.S., and U.S. Customs and Border Patrol (CBP) will not allow visitors to enter if they are in possession of such illegal contraband. Under the U.S. Federal Controlled Substances Act, it is illegal to:
(1) sell or offer for sale drug paraphernalia;
(2) mail or use any other facility of interstate commerce to transport drug paraphernalia; or
(3) import or export drug paraphernalia.
What are drug paraphernalia?
Drug paraphernalia means any equipment, product or material which is primarily intended to be used in manufacturing, preparing, injecting, ingesting, inhaling, or in some other way introducing a controlled substance into the human body
This includes:
- Pipes (glass, wood, stone, plastic or ceramic);
- Water pipes and bongs; and
- Roach clips (used to hold joints that are too small to be held by hand).
If you attempt to bring illegal drug paraphernalia into the U.S. you will be subject to the same penalties as if you were smuggling cannabis, including seizure of the products, fines, penalties, and possible arrest.
