Effects of injunctions on settlement
Region: Ontario Answer # 1547Once an injunction is in place and the fraudster is not able to deal freely with assets in their control, they are much more likely to seek a settlement. This is most common in cases where, in obtaining an ex parte Mareva injunction, the victim presents an extremely strong case of fraud, and then immediately persists in obtaining an interim injunction and then an interlocutory injunction.
