Is a Canadian medical marijuana licence valid in any of the U.S. States?
Region: Ontario Answer # 2587No. A Canadian medical marijuana (cannabis) licence is not valid in any of the U.S. states. As well, you cannot bring cannabis or any product containing cannabis (including CBD oil), into the U.S. It is illegal to do so and can result in serious penalties.
However, while your medical marijuana card is only valid in Canada, you may be able to purchase medical marijuana if you qualify as a resident of that State and suffer from a condition that qualifies for medical marijuana use.
For example:
Florida
In Florida, to access to marijuana for medical purposes you must have a Medical Marijuana Use Registry (MMUR) identification card, which is issued by the Florida State health department. Generally, you must be a Florida resident to be issued a MMUR card. However, Canadians may be issued a MMUR identification card if they:
- spend at least 31 days in Florida and return home for the remainder of the year;
- have proof of residency, such as a lease document, local phone or utility bill, or banking statement; and
- receive an assessment from a US medical marijuana physician certified by the State of Florida that states the conditions the medical marijuana could be prescribed for, and recommends the best products and dosages for the patients medical needs.
Once the assessment is completed it is forwarded to the MMUR. You will then be issued a permit that is valid for one year and can be used at any dispensaries in Florida. There are costs for both the assessment and the government licence.
Arizona
In Arizona, Canadians can obtain a medical marijuana card (known as a MMJ) to legally purchase and use medical marijuana if they:
- spend at least 30 days in the state and have proof of residency;
- suffer from a condition that qualifies for medical marijuana use in the State (Cancer, Glaucoma, HIV/AIDS, Hepatitis C, ALS, Crohn’s Disease or Alzheimers), or any chronic or debilitating disease or medical condition;
- have a State certified physician complete an Arizona Department of Health Services (ADHS) medical marijuana certification form; and
- register with ADHS and submit and application for a MMJ (for a fee).
Keep in mind that although cannabis remains illegal under U.S. federal laws, medical cannabis has been legalized in every state, and recreational cannabis has been legalized in many states. Therefore, it may be possible for you to purchase the cannabis you need without a medical marijuana licence. The rules around the legalization of cannabis in the U.S. are constantly changing. Check the rules in the State you wish to visit for the most up-to-date information.
