What is Reservist Leave?
Under the Employment Standards Act, employees who are reservists in the Canadian Forces are eligible to an unpaid leave of absence from their job if they have been employed for at least six consecutive months, and are:
- deployed to an operation overseas, or
- deployed to an operation within Canada that is or will be providing assistance in dealing with an emergency or its aftermath (including search and rescue operations, recovery from national disasters such as flood relief, military aid following ice storms, and aircraft crash recovery).
How long is leave?
The leave of absence must continue for as long as the deployment lasts, and employees are entitled to be reinstated to the same position if it still exists or to a comparable position if it does not after their deployment ends.
In most circumstances, reservists must give their employer reasonable written notice of the day on which they will begin and end the leave.
