Privacy and AI
Region: Ontario Answer # 8003In Canada, the federal government and each province have existing privacy laws. Currently, AI and privacy issues are governed by these existing laws, including:

In addition to the changes that would be implemented through the new Federal legislation, Artificial Intelligence and Data Act (AIDA), the Office of the Privacy Commissioner (“OPC”) has expressed support for a rights-based framework for AI in response to current AI developments. This rights-based approach, should it be implemented, would advocate and encourage clear accountability in AI systems. However, it would permit certain exceptions to the consent rules, especially when the use of personal information likely would have social benefits. It should be noted that while the OPC’s position is not legally enforceable, it would provide a foundational perspective for handling privacy concerns in the AI landscape.
