Are process servers licensed?

In Canada, there is no standard licensing or certification requirement for process servers. However, provincial legislation may set out various rules regarding the process of service procedure, such as who can serve documents and what methods of service are acceptable.

Do process servers require any special training or education?

Although they do not require a licence or certification, process servers must be fully knowledgeable of the laws in their province in order to carry out their duties competently. Knowledge of international or cross-border process serving laws is also important.

Process servers have often taken educational courses in subjects related to process serving, such as criminal justice and law enforcement. Available at local community colleges, universities or online, this education may even be a requirement for employment as a process server with a private company or government body. As well, although some process servers may receive on-the-job training when they are hired by a company, previous experience in law enforcement is highly regarded.
