If my mother was born in the UK, am I automatically a British citizen ?
Region: Ontario Answer # 6163Whether your mother’s UK birth makes you a British citizen depends primarily on when you were born. The rules changed significantly on 1 January 1983 when the British Nationality Act 1981 came into force.
Born on or after 1 January 1983: You will have acquired British citizenship automatically at birth if your mother was a British citizen otherwise than by descent at the time, meaning she acquired her citizenship through birth in the UK rather than through her own parent. If she were already a British citizen by descent, the situation would be more complex and depend on additional factors.
Born before 1 January 1983: Earlier nationality legislation applied, and the rules were different depending on the year of your birth and your parents’ circumstances. Many people born during this period to British mothers were not able to acquire citizenship automatically, though remedial routes — including under section 4L — may now be available.
If you are a British citizen, you are entitled to apply for a British passport. Applications from Canada can be submitted through HM Passport Office, with supporting documents sent by post. Processing times vary.
