What are the suitability requirements for UK Family Visa applications?

UK Family Visa applications are assessed under two broad areas: eligibility and suitability.

Eligibility relates to the relationship, financial requirement, accommodation, and English language criteria. Suitability focuses on the applicant’s background and conduct.

An application may be refused if the applicant’s presence in the UK is considered not conducive to the public good. This can arise from:

  • Criminal convictions, particularly custodial sentences;
  • Previous immigration breaches (such as overstaying or breaching visa conditions);
  • Deception in a prior visa application; or
  • Entering the UK unlawfully.

Suitability is assessed separately from eligibility. Even if you meet the relationship and financial requirements, your application can still be refused on suitability grounds.

A custodial sentence of 12 months or more will normally result in mandatory refusal, regardless of when the conviction occurred. Other criminal convictions, out-of-court disposals, or immigration breaches may lead to refusal at the Home Office’s discretion.  The Home Office is the UK government’s lead department for immigration, border security, policing, and counter-terrorism.

The Home Office also considers whether an applicant has previously used false information or fraudulent documents. Failure to disclose relevant information can result in refusal and lengthy re-entry bans. For this reason, full transparency about any criminal history or prior immigration issues is essential before submitting a family visa application.
