Will a marriage that did not take place in UK be recognized for a UK Spouse Visa?

A marriage that took place outside the UK can be recognized for the purposes of a UK Spouse Visa, provided it was valid under the laws of the country where it took place and does not fall foul of UK public policy.

The Home Office will need to be satisfied that both parties had the legal capacity to marry at the time, that the marriage was properly conducted in accordance with local law, and that neither party was already married to someone else. Marriages recognized in the country where they took place are generally accepted.

You will need to provide your original marriage certificate, or a certified copy, as part of your British Spouse Visa application. If the certificate is not in English, a certified translation will be required.

Marriages conducted in religious ceremonies without a corresponding civil registration may not be recognized, even if they are culturally significant in the country where they took place. This is a common issue for Canadian applicants who married in countries where civil and religious marriage registration are handled separately.
