Visa options for Canadian whose child lives in the UK with their other parent

Region: Ontario Answer # 6140

If your child lives in the UK and is a British citizen, an Irish citizen, or holds ILR, and you are no longer in a relationship with your child’s other parent, you may be able to apply for a Parent of a British Child Visa. This route is designed to enable a parent living abroad to relocate to the UK and play an active and meaningful role in their child’s upbringing.

To qualify, you must demonstrate one of the following: that you have sole parental responsibility for your child, or that you have direct in-person access to your child — whether by agreement with the other parent or through a family court order. A purely online or telephone relationship is not sufficient; the Home Office will expect evidence of regular, meaningful in-person contact.

You must also show that you take an active role in your child’s upbringing — through involvement in decisions about education, healthcare, and general welfare — and that you can support yourself financially without recourse to public funds. Unlike the Spouse Visa, there is no fixed minimum income threshold for this route, but you will still need to provide evidence of your ability to maintain and accommodate yourself in the UK.

The child must be under 18, unmarried, and not living an independent life. These applications require careful documentary preparation, and the Home Office scrutinizes them closely.
