Separation Agreements can be prepared in one of three ways:

1. Spouses to prepare their own Separation Agreement, or
2. Spouses can hire lawyers to prepare their Separation Agreement; or

Ontario’s Family Law Act mandates that a Separation Agreement must be in writing and signed by both parties. It must also be witnessed by an individual who is at least 18 years old. This witness cannot be a party to the Agreement.
