When should you get a prenup / marriage contract?
Region: Ontario Answer # 0178There is no fixed deadline in Ontario law for signing a prenup, the Family Law Act (FLA) allows spouses to sign one before, on, or even after the wedding. Timing, however, affects how likely the agreement is to hold up if is ever challenged.

Signing before the wedding
Ontario courts have scrutinized agreements signed at the last minute, such as the night before or the morning of the wedding, because rushed timing can support an argument that a party did not understand the agreement or felt pressured into signing it. Many family lawyers recommend starting the process at a few months before the wedding date, to leave time for financial disclosure, drafting, and independent legal advice for each party.
Signing after the wedding – a “Postnuptial” Agreement
An agreement signed after the marriage, sometimes described informally as a “postnuptial agreement” is still a legal a marriage contract under the FLA. The same formal requirements and the same grounds for setting the agreement aside apply regardless of when it is signed.
What might help decide when you should sign an agreement?
- Entering the marriage with significant pre-existing assets, such as a business, real estate, or an inheritance.
- A second or later marriage, particularly where children from a prior relationship are involved.
- A significant income or wealth difference between the two spouses.
Once a couple has made major joint purchases or had a child, negotiating financial terms can become more complicated. Addressing these questions early generally leads to calmer negotiations and a more defensible agreement.
