Are Separation Agreements legally binding?

Yes, a separation agreement is legally binding in Ontario, provided it meets the statutory requirements set out in the Family Law Act. A separation agreement is a type of domestic contract that outlines each party’s rights and responsibilities regarding their children, property, and finances.

Under Section 55(1) of the Family Law Act, a separation agreement is only enforceable if it is:

  • In writing – the agreement must be in writing; verbal agreements are not enforceable
  • Signed by both parties – the final document must be signed by both partners
  • Witnessed – there must be a witness, who is at least 18 years old, to watch each spouse sign the agreement, and they must add their own signature to confirm it happened

Enforcement

Once these requirements are met, both parties are legally obligated to follow the terms of the agreement. If one party does not comply with the terms of the agreement, the other party can take legal action to enforce them.

When a Separation Agreement may be overturned

Although a separation agreement is legally binding in Ontario, it may be overturned under Section 56(4) of the Family Law Act if:

  • A party failed to disclose significant assets, debts, or other liabilities that existed at the time the agreement was made
  • A party did not understand the nature or consequences of the agreement
  • The agreement is invalid under general contract law principles
