Can someone legally grow cannabis at home?

Under Canada’s Cannabis Act, adults who are 18 years or older (depending on the province) can legally grow up-to 4 plants (per residence) for personal use. The cannabis must be grown from seeds or seedlings bought from licensed cannabis retailers.
Provincial regulations for home growth
Although the federal law allows people to grow cannabis at home, each province and territory can decide if they will follow federal law. Currently, Quebec and Manitoba have banned growing non-medical cannabis at home.
Provinces also can impose additional requirements or restrictions on home growth. For example, conditions may include:
- plants must be kept in a separate, locked space, such as a separate room or cabinet indoors, or a secured tent or shed outdoors
- plants must be inaccessible to minors
- plants cannot be grown in a space that is visible from a public place
Growing cannabis in apartments or condos
For those living in rental apartments or condominiums, they must be sure their landlord or condo corporation allows home growth. Property owners, and condo governing boards or associations have the authority to make condo policies and bylaws to prohibit growing cannabis in their individual units and buildings. As well, landlords can add clauses to a new tenant’s lease banning cannabis use or growth in their units.
In most cases, a landlord can apply to evict a tenant if his or her smoking, or growing plants, causes damage to the rental unit.
